Complainant filed a complaint alleging employment discrimination in violation of the Rehabilitation Act. The Equal Employment Opportunity Commission (EEOC) found that rehabilitation and limited-duty employees were discriminated against when they were subjected to (1) withdrawals of their reasonable accommodations; (2) hostile work environments; and (3) disclosures of confidential medical information. On appeal, the Class Agent alleged that the final decisions for Class Members’ individual claims were issued in violation of the Commission’s process for relief claims. The EEOC’s Office of Federal Operations (OFO) held that any disputed claims by class members should be decided by the Administrative Judges before issuing a final dispute on said claims.
