Federal employees lose sex discrimination appeal. Complainants filed appeals with the Equal Employment Opportunity Commission (EEOC) from the Agency’s final decisions (FAD) in each of their cases. 

The FADs concluded there was no discrimination in violation of the Civil Rights Act or the Equal Pay Act (EPA).  The EEOC’s Office of Federal Operations (OFO) consolidated the appeals. The issue was whether the Complainants could show discrimination when they were hired at the GS-07 grade level rather than the GS-09 grade level. The OFO further held that Complainants had failed to establish a prima facie violation of the EPA. It also found no violation of Title VII. The OFO affirmed the FADs.
