Federal employee wins EEOC appeal. Complainant, a federal employee, filed an EEO alleging sex discrimination related to her pay. The VA issued a FAD finding no discrimination. Complainant then filed an appeal with the EEOC’s Office of Federal Operations (OFO). The OFO found that the Agency did not meet its burden of proof on one of the claims because it only provided vague statements to justify the pay differential. Further, OFO found that there was a lack of information reflecting how the salaries of the Complainant and comparators were set. The EEOC awarded back pay and liquidated or compensatory damages. It ordered the Agency to perform a supplemental investigation to determine Complainant’s compensatory damages.
