Federal employee prevails in Agency appeal. Complainant was employed by Department of Homeland Security. He filed an EEO alleging discrimination on the basis of race, color, age and reprisal for protected activities. An EEOC Administrative Judge held a hearing and found in his favor. The Agency appeal the decision and Complaint cross appealed. Ultimately, the EEOC’s Office of Federal Operation found in Complainant’s favor on most of the appeals issues. The key take away though was the EEOC holding that attorneys fee rates are determined at the prevailing rate in the jurisdiction at the time of the filing of the petition, not historical rates.
