EEOC lacks jurisdiction over Peace Corps Volunteers or Applicants. Complainant concurrently filed an Equal Employment Opportunity (EEO) complaint with the Department of State and with the Peace Corps EEO office alleging discrimination on the basis of disability (anxiety and depression). The Department of State dismissed the complaint for failure to state a claim because Complainant was an applicant with the State. Complainant appealed.
On appeal, the EEOC’s Office of Federal Operations (OFO) held that it lacks jurisdiction to consider appeals from Peace Corps volunteers and applicants that have a separate EEO complaint process.
