EEOC Judge’s decision finding harassment based on age and reprisal upheld. Complainant, a federal employee, filed an EEO alleging harassment based on age and reprisal. After an investigation, she requested a hearing before the Equal Employment Opportunity Commission (EEOC). The EEOC Administrative Judge found in Complainant’s favor. However, the Agency rejected the decision and appealed to the EEOC’s Office of Federal Operations (OFO). The OFO found that substantial evidence supported the Administrative Judge’s findings and upheld the final order.
