EEOC finds in favor of federal employee. Complainant, a federal employee, filed EEOs alleging discrimination on multiple bases. After a remand from an EEOC Administrative Judge, the Agency issued a Final Agency Decision (FAD) which either dismissed or denied all of Complainant’s claims. Complainant filed an appeal with the Employment Opportunity Commission’s (EEOC) Office of Federal Operations (OFO). The OFO determined that the Agency provided legitimate nondiscriminatory reasons for the majority of the Complainant’s claims. However, the OFO found that the Agency had violated the Rehabilitation Act in its handling of the Complainant’s medical information. The Complainant was awarded attorneys fees and the case was remanded for a decision regarding compensatory damages for the Rehabilitation Act claim.
