EEOC: Federal employee wins appeal against VA. Complainant, a federal employee, filed an EEO alleging disability and age discrimination. At the end of the investigation, Complainant did not request an EEOC hearing. Thereafter, the VA issued its final agency decision (FAD) finding no discrimination against complainant. Complainant filed then filed an appeal with the EEOC’s Office of Federal Operations (OFO). The OFO found that the Agency’s failure to engage in an individualized assessment of Complainant’s circumstances. Thus, the Agency could not meet its burden of proving that undue hardship on Complainant’s request for reasonable accommodation.
