EEOC: Federal employee not subjected to pay discrimination. Complainant filed an EEO alleging he was subjected to pay discrimination on the basis of sex and race. After a investigation, he request an EEOC hearing. The EEOC Administrative Judge (AJ) issued a decision finding that the Agency did not discriminate against Complainant. The Agency issued a FAD in agreement with the AJ and Complainant appealed to the EEOC’s Office of Federal Operations or OFO. The OFO held that Complainant was not similarly situated to his comparator. Further, OFO held that even if he had been able to show discrimination the Agency was able to show a legitimate non-discriminatory reason for the pay disparity.
