EEOC: Federal employee claim not sufficiently investigated. Complainant, a federal employee, filed an EEO alleging discrimination, harassment and hostile environment. The USPS issued a Final Agency Decision (FAD) finding no discrimination, harassment or hostile environment. Complainant filed an appeal of the postal service’s FAD with the Equal Opportunity Commission (EEOC). The EEOC’s Office of Federal Operations (OFO) held that the investigative record surrounding the claims of harassment/hostile work environment was not adequately developed, especially because no witnesses were interviewed. The OFO remanded the complaint to the Agency for further investigation ordering the Agency to interview all potential witness, and to require certain witness statements to be taken under oath.
