After a hearing, an EEOC AJ awarded $200,000 in non-pecuniary (emotional distress) damages, $223,116.35 in pecuniary (lost wages) damages and $131,262.50 in attorneys fees and costs. The Agency appeal to the EEOC’s Office of Federal Operations. On appeal, the OFO affirmed the awards to the complainant of $200,000 in emotional distress and $223,116.35 in pecuniary damages. However, the OFO did reduce the attorney’s fee and costs award to $122,150.00
